What you're leaving out is significant.
When approached and told, you're duping someone's existing product the response was to contact the original designer and work out an equitable arrangement that both could agree on. That this arrangement was made was passed on to the Staff with the understanding that both parties were amenable to it and wanted to put the issue behind them and move forward.
This is in stark contrast to your response upon being informed that it was a dupe of someone's existing product. You told him that he did not have a Patent and your version of working it out was to offer him a free lock.
A rather substantial difference in response I would say.
So yes, it does not look like equal treatment, that's because it was NOT an equivalent event.
I would not expect different courses of action to result in the same end.
