NEW ATF FORM FOR FLL's where lowers are put in the "other spot"
« on: October 13, 2008, 12:55:14 PM »
Is this going to affect gifting lon arms to a sibling. If I gift my lower to my son, do I now have to go through an FLL?

No.
There's no registration of long arms and no requirement of paperwork that I am aware of.
The inter-family transfer process is mostly to change the handgun owner registry database entry.

This also applies to curio and relic purchased face-to-face.
Just cash and carry.

I bought an early 50's remington 870 this way recently.

In tenpercents thread, they were saying Lowers were no longer marked Pistol or rifle, but were checked Other and could no longer be sold to anyone under 21.

I think that only applies to original purchases, not to transfers.  I'm pretty sure that you can IFT a handgun to someone under 21 (but over 18) even though they can't buy a handgun from a dealer if they're under 21.

Inter family transfer is different though.
There is no "sale" there.
There is no DROS requirement either.
Only handguns are registered, so if there is no sale and no dros requirement, where is the problem?
Remember that there's also no problem with 18-21 owning handguns.
They just can't BUY handguns.
A father can gift his 18yr old a handgun and he sends $19 in to the state with the inter-family transfer form to register it in his name.
